Terms of Service

The terms governing your use of the Empire Health platform.

Last updated: June 20, 2026

1. Acceptance of Terms

By accessing or using the Empire Health website, mobile application, or telehealth platform (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services. These Terms constitute a legally binding agreement between you and Offer Empire, LLC.

2. Eligibility

You must be at least 18 years of age and a resident of a US state in which Empire Health operates to use the Services. By using the Services, you represent and warrant that you meet these requirements. The Services are not available to residents of states where our physician network or pharmacy partners are not licensed.

3. Nature of Services

Empire Health provides a telehealth platform that connects patients with independent, licensed physicians for online medical consultations. Empire Health is not a medical provider, does not practice medicine, and does not employ physicians. Physicians on the platform are independent licensed practitioners. Empire Health also partners with state-licensed compounding pharmacies to fulfill prescriptions issued by platform physicians. All physicians and pharmacy partners are duly licensed in the jurisdictions they serve.

4. No Guarantee of Prescription

Completing an intake assessment does not guarantee that a prescription will be issued. A licensed physician independently reviews each intake and exercises independent medical judgment. Empire Health does not influence physician prescribing decisions. A $40 consultation fee applies to declined or incomplete consultations.

5. Compounded Medications

Medications dispensed through Empire Health are compounded by state-licensed compounding pharmacies. Compounded medications are not FDA-approved and have not undergone FDA premarket review for safety, effectiveness, or quality. They are prepared under Section 503A of the Federal Food, Drug, and Cosmetic Act pursuant to a valid prescription. Empire Health only dispenses or facilitates the dispensing of prescription medications upon receipt of a valid prescription issued by a licensed prescriber authorized to practice in the patient's jurisdiction.

6. SMS Communications

By providing your mobile phone number and opting in to SMS communications during registration or checkout, you consent to receive text messages from Empire Health (Offer Empire, LLC) regarding your account, orders, prescription status, and service updates. Message frequency varies. Message and data rates may apply. To opt out, reply STOP to any message. You will receive one confirmation message upon opting out. To re-subscribe, reply START. For assistance, reply HELP or contact support@empire.health. Opting out of SMS does not affect your access to services or other communication channels. We do not share your phone number or SMS opt-in data with third parties for their own marketing purposes.

7. Subscription Terms

Subscription orders renew automatically on your selected schedule until cancelled. You may pause, skip, or cancel your subscription at any time through your account dashboard with no cancellation fee. Cancellations take effect immediately and stop future billing and shipments. Refunds are not provided for shipments already processed.

8. Prohibited Uses

You agree not to: (a) provide false or misleading health information; (b) share, sell, or transfer your prescription to any other person; (c) use the Services for any unlawful purpose; (d) attempt to reverse-engineer, scrape, or interfere with the platform; or (e) use the Services if you have a contraindication to the requested medication.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EMPIRE HEALTH AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

10. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules.

11. LegitScript Certification

Empire Health is committed to operating in compliance with all applicable federal and state laws governing telemedicine and pharmacy services. Our physician partners are independently licensed in the states they serve. Our pharmacy partners are state-licensed compounding pharmacies. We maintain accurate business registration information and disclose all operational websites as required by our compliance obligations.
